  1. GENERAL

 

  • These Terms and Conditions (“Terms”) tell you information about us and the terms of business under which we, NINJA LEISURE UK TEESSIDE LTD (NLUK Teesside) – also referred to as “Licensed Ninja Warrior UK Venue Operator” and/or “Licensed NWUK Venue Operator” and/or “Venue Operator(s)” – supply services to you and the participants within your booking(s).
  • For further information about us and our services, please visit our website https://ninjawarrioruk.co.uk/teesside/ before you make your booking.
  • We are NINJA LEISURE UK TEESSIDE LTD, a company registered in England and Wales under company number 13266281 with registered address, 14 Jensen Court, Astmoor Industrial Estate, Runcorn, England, WA7 1SQ.
  • Venue Address: Unit L3 New Mersey Retail Park Speke Road, New Mersey Retail, Teesside L24 8QB.
  • We operate a Ninja Warrior UK-branded leisure venue under the name Ninja Warrior UK Adventure Park Teesside. The Ninja Warrior UK brand has been licensed to NINJA LEISURE UK TEESSIDE LTD by ITV Broadcasting Limited (“ITV”) and the ultimate Intellectual Property owner is Tokyo Broadcasting System Television, Inc (“TBS”).
  • In these Terms, the words “we” and/or “us” refer to NLUK Teesside. As the Venue Operator we are independently responsible for legal and regulatory compliance and the operation of the venue.
  • Please note that all bookings, whether made either through our website at https://ninjawarrioruk.co.uk/teesside/ over the telephone or in person at the Venue, are made directly with the Venue Operator that operates that specific Venue and which is also responsible for the website and the site that you have booked at.  Please also note that bookings are not transferable between different venues operated by different venue operators.
  • The resulting legal contract is between you and the relevant Venue Operator that runs the Venue that you have made a booking for and is subject to these Terms.
  • Any issues/queries arising from and/or relating to any booking(s) made by you through our website, over the telephone or in person at the Venue must be raised directly with the Venue Operator of Ninja Warrior UK Adventure Park Teesside (NLUK Teesside).

 

  1. GROUP BOOKINGS

Where you are making a group booking, each participant shall be subject to these Terms as if they were making the booking themselves and you hereby undertake that you shall ensure that these Terms are agreed with by each participant of your group booking, including the Parent/Legal Guardian or Supervising Adult of a minor participant (a minor being anyone under the legal age of 18 at the time of booking), before you confirm your booking with us. For the avoidance of doubt, references to “you” and/or “I” in this agreement shall apply severally to each participant in the applicable group booking.

  1. COPYRIGHTS & TRADEMARKS

 

  • All Ninja Warrior UK formative marks, images and logos are subject to copyright, design rights and trademarks of Tokyo Broadcasting System Television, Inc, licensed by ITV Broadcasting Limited. All rights reserved.
  • Nothing contained in these Terms shall be construed as conferring by implication or otherwise any licence or right to use any trademark, patent, design right or copyright on this website.
  • This website contains material which is produced by, owned by or licensed to the Venue Operator. This material includes, but is not limited to, the design, layout, look, appearance, text and graphics. Reproduction is prohibited.
  • Under no circumstances will ITV or TBS or any of their affiliated companies be liable for any of the following losses (whether such losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of this website or any Site regardless of the form of action. For the avoidance of doubt, neither ITV or TBS warrant that functions contained in this website will be uninterrupted or error-free, that defects will be corrected, or that this website or the server that makes it available are free of viruses or bugs.

 

  1. CONSENT & RELEASE

 

  • You agree as an adult participant, or the Parent/Legal Guardian or Supervising Adult of a minor participant (a minor being anyone under the legal age of 18 at the time of booking), or, where you are making a group booking, you expressly agree for and on behalf of each other member of your group booking, and in consideration of being permitted to participate in the activities at the Venue, give permission to be photographed and/or for video recording of all members of the applicable booking group and/or any minors within the booking group to take place whilst within the Venue, such imagery/video footage is only to be used for advertising and promotional purposes by the Venue Operator. You agree to waive all your (and each member of your booking group’s) rights to inspect or approve the use of any imagery and/or video footage, and acknowledge and agree that the rights granted to this release are without compensation of any kind.
  • You, and each member of your group booking, expressly agree and hereby undertake that you, or any member of your group booking, shall not record the Venue, nor reproduce, broadcast or transmit such footage, in any manner or by any means whatsoever, in the absence of a specific written agreement with NINJA LEISURE UK TEESSIDE LTD relating to and permitting such recording, reproduction, broadcast or transmission.
  • If the participant(s) is a minor, or are minors, (a person under the legal age of 18 at the time of booking), you, and each member of your group booking, agree that this Release of Liability and Assumption of Risk Agreement (“RELEASE”) is made on behalf of any minor participant(s) and that all of the releases, waivers and promises herein are binding on any minor participant(s). You, and each member of your group booking, warrant that you, and each member of your group booking, have full authority as either the Parent, Legal Guardian or as a Supervising Adult of the minor participant(s) to bind the minor participant(s) to these Terms.

 

  1. OUR CONTRACT WITH YOU

 

  • The Venue Operator provides access to a number of activities, which include trampolining, climbing elements, inflatable elements and as well as participating in classes and parties (“Activities”).
  • The Licenced Ninja Warrior UK Venue Operator provides access to a number of supervised activities which involve balance, strength, and agility including: jumping and climbing elements, swinging from obstacle to obstacle, running up a graduated curved wall, inflatable elements and as well as participating in classes and parties (“Activities”).
  • These are the Terms which apply when you book to take part in and subsequently participate in any activity with the Venue.
  • Please ensure that you and all of the participants within your booking(s) have read these Terms in advance of attending the Venue. You should also check that the details of your booking are complete and accurate before you finally confirm your booking(s). If you think that you have made a mistake after you have confirmed your booking(s), please contact the relevant Venue (that you have booked at) to discuss.
  • By processing and/or confirming your booking, you agree that access to any of the activities within the Venue, as provided by the Venue Operator, and your participation in any of the available activities within the Venue is subject to these Terms.
  • No booking shall be deemed to have been accepted by the Venue Operator unless and until the booking has been confirmed in writing by the Venue Operator, which will usually take the form of email confirmation via the online booking platform. Please note that we will not issue refunds in the event you misread the date/time of a booking unless a request is made in accordance with clause 9 of these Terms.
  • These Terms also incorporate the terms of the site rules, the Participation Waiver and privacy policy.
  • The Venue Operator reserves the right to revise these Terms without notice and to make changes to the activities available within the Venue from time to time in order to comply with changes in any relevant laws or regulatory requirements.

 

  1. YOUR OBLIGATIONS

 

  • You shall ensure that the terms of your booking and any information provided therein is complete and accurate.
  • You shall co-operate with us in all matters relating to the Activities.
  • You shall provide us, our employees, agents, consultants and subcontractors with such information as we may reasonably require in order to supply the Activities and ensure that such information is complete and accurate in all material aspects.
  • Unnecessary noise or any behaviour likely to cause annoyance to other guests or confusion of any kind is not permitted in any part of the Venue. Smoking (including of e-cigarettes) is strictly prohibited other than in the designated smoking areas identified at the Venue. All activities at the Venue must only be used in accordance with the relevant operator’s instructions and the Venue Operator retains the right to reject any participant who does not comply with these obligations without prejudice to any other rights of refusal of entry to the Venue contained in this agreement.
  • It shall be the responsibility of all participants to ensure that they are dressed appropriately and the Venue Operator advises participants to wear clothing appropriate for the activity and which they do not mind getting damaged. In particular the following restrictions shall apply:

 

  • Long hair must be tied back;
  • No belts, jewellery or other sharp items of clothing that may cause damage to yourself, the equipment or other participants;
  • The Venue Operator will not be responsible for any damage to or loss of clothing or other personal items resulting from participation in the Activities; and
  • All users of the inflatable activity areas must wear Ninja Warrior UK-branded hygiene socks which can be purchased at reception on arrival, or online in advance.

 

  1. SAFETY

 

  • Participant sessions are for ages 4 and above. We advise that an accompanying adult participates with anyone aged under 8 years.
  • For Mini Ninjas session bookings only Under 4s can use the soft play equipment area. Whilst we don’t have a minimum age for these sessions, we do recommend that participants are already able to walk in order to enjoy the equipment.
  • Under 4s may use the inflatables at the Venue between 9am-12pm Monday to Friday only. No child under 4 shall be granted access to the inflatables if in use by a participant over the age of 4, but this shall exclude accompanying parents or guardians of a child under 4 using the inflatables.
  • Some of the activities will require you to be 1.25m or 1.4m minimum in height.
  • Participation in the Activities is not without risk as serious misuse could be fatal. You acknowledge that the Activities can be dangerous with many inherent risks and hazards. As a consequence personal injury, and sometimes fatality, can occur. You and all participants within your booking(s) voluntarily assume and accept all such risks and irrevocably waive the right to sue the Venue Operator for any personal injury or fatality and agree to the on site Rules, as displayed within the venue and or as communicated by staff within the Venue. All participants are required to watch and acknowledge having seen the Safety Video Briefing before accessing any of the activities within the Venue.
  • All participants will be directed to the Safety Briefing Area, the Venue Operator’s staff. The Safety Briefing must be undertaken prior to engaging in any Activity. We strongly advise all participants to wear grip gloves (available for purchase within the venue) to increase grip and for hygiene reasons whilst taking part in any activity within the venue.
  • After attending the Safety Briefing, participants acknowledge that they will not be individually supervised by Venue Operator staff.
  • People with special educational needs and disabilities cannot participate in the activities unless they are accompanied by a parent, guardian, responsible adult or appropriate carer. The parent, guardian, responsible adult or carer must remain on site for anyone under 12 years of age or anyone with special educational needs and disabilities . One adult is permitted to supervise a maximum of ten under-12 year-olds. Venue Operator personnel will not supervise children, regardless of the child’s age, or anyone with special educational needs and disabilities at any time. For participants under the age of 18 or participants who lack capacity, a parent, guardian, responsible adult or carer is required to understand and acknowledge the Safety Rules on behalf of the participant, stating that he or she will accept responsibility for the safety of himself or herself and for supervision of any children or anyone with special educational needs and disabilities in his or her care. Such parent, guardian, responsible adult or carer will ensure that all participants under the age of 18 or who lack legal capacity have read and understood the Safety Rules.
  • The Activities are physically demanding and require a degree of strength, balance, agility and stamina. All participants must be reasonably fit, in good health and free from any adverse medical condition. All participants are subject to the age and weight restrictions for each Activity as are stated in the Venue Operator’s FAQ’s (https://ninjawarrioruk.co.uk/teesside/frequently-asked-questions/) at time of booking. The weight limit for an individual (fully clothed) participant is 127kg. Participants confirm that they do not exceed this weight. If you have any concerns we advise that you visit the Venue prior to making your booking and speak to a member of the Venue Operator team. The Venue Operator recommends that if you have weight-related concerns you should consult your health service provider and receive medical clearance before participating in an Activity at the Venue.
  • Participants are advised to use activities within the venue based on their confidence, experience and ability. If you are unsure as to whether you can complete a manoeuvre, you should not attempt it. If participants have medical concerns they are advised to consult their doctor before attending. Participants warrant that, to the best of their knowledge, they do not suffer from any medical condition or other reason which may prevent them from participating in any of the Activities or which would make it more likely that they would be involved in an incident which could result in injury to themselves or others. For clarity, if you are pregnant, have a heart condition, or wearing any form of plaster cast, you are not allowed to participate in any of the Activities. Participants at the Venue are personally responsible for their own personal well-being.
  • Participants need to be able to see similar distances to those required to drive a car in order to be able to participate in an Activity and/or to supervise anyone in their care. Consequently, we would recommend that short or long-sighted participants wear contact lenses and remove glasses.
  • Anyone who does not meet the requirements in respect of an Activity will not be allowed to undertake that Activity. It is your responsibility to ensure that all participants in your booking meet these requirements.
  • The Venue Operator reserves the right, in its absolute discretion to refuse admittance to participants to the Venue, ban from entry to the Venue, or to remove a participant from the Venue without any right to a refund, any person whose presence or behaviour may affect the enjoyment and/or safety of other guests or staff or who, in its opinion, does not comply with the requirements set out in these Terms. This includes a participant:
    • who does not comply with the Safety Rules and/or instructions of any Venue Operator staff member;
    • whose behaviour is considered unsafe or who is thought to be under the influence of alcohol or drugs;
    • who acts in an inappropriate and/or undesirable manner whilst travelling to the Venue where such behaviour has been reported to us by a reliable independent source;
    • who has been convicted of a criminal offence relating to us;
    • who uses violent, aggressive, threatening, abusive, discriminatory or insulting words or behaviour or in any way behaves in a manner which may provoke a breach of the peace;
    • who has displayed any sign or visible representation of any kind which is, or could be reasonably judged to be, threatening, abusive or insulting;
    • who has previously acted in any manner which has caused the Venue or any person to report that individual to us;
    • who is attempting to gain admission to the Venue without a valid booking; and
    • who damages or defaces any aspect of the Venue or the equipment at the Venue.

If any guest in breach of any of the above conditions is a member of a group, then such group of individuals may also, at our discretion, be denied entry or escorted from the Venue without any right to a refund. We reserve the right to initiate legal proceedings or prosecute any person found damaging or defacing any part of the grounds, barriers, walls, exhibits, fabrics or buildings at the Venue. At our discretion, future access to the Venue may be denied to any guest who has previously been denied entry or escorted from the Venue.

  • All participants are required to act responsibly and courteously at all times and to respect other participants and Venue Operator staff. The Venue Operator shall be entitled to prevent any person from undertaking or completing the Activities in the event it deems the behaviour of any participant unsuitable. The decision of the Venue Operator Manager/Duty Manager will be final.
  • Participants must be dressed appropriately (please see the FAQ’s section of our website at https://ninjawarrioruk.co.uk/teesside/frequently-asked-questions/) the Venue Operator may refuse entry to any participant who is not appropriately dressed.
  • No refunds or compensation will be payable by the Venue Operator in the event that any participant is not permitted to, or decides not to, undertake or complete the Activities for any reason.
  • For the avoidance of doubt, bicycles, hover-boards, roller-blades or similar devices are not permitted within the Venue.
  • No weapons, dangerous articles such as fireworks or smoke bombs, glass bottles or other potential harmful items may be brought into the Venue. Guests are admitted to the Venue subject to the condition that, if requested to do so, they will allow themselves and/or their belongings to be searched. The throwing of any article which could cause injury or affect the enjoyment of other guests is strictly prohibited.  Any person found to be in possession of an article deemed to be offensive or dangerous will be immediately escorted from the Venue without any right to a refund and we reserve the right to make reports to the relevant authorities which may lead to prosecution. Any persons found possessing alcohol, or who appear to be under the influence of alcohol may be refused admission to the Venue or escorted from the Venue without any right to a refund.  The use or possession of illegal substances and/or legal highs are strictly prohibited and any persons found possessing, using or who appear to be under the influence of illegal substances and/or legal highs will be refused admission or escorted from the Venue without any right to a refund.

 

  1. PRICE AND PAYMENT

 

  • Subject to any terms agreed in writing between the Venue Operator and you, our charges for all activities and all ancillary products (such as grip gloves) shall be calculated at our current rates from time to time.
  • All charges include VAT.
  • Payment shall be made in full at the time of booking and can be made by using a debit card or credit card. All payments are made via the online booking platform or on terminals within the Venue.
  • The Venue Operator reserves the right to change its prices at any time. Though any change in price will not affect any Activities which have already been booked and paid for in full at the time that the change in price becomes effective.

  1. CANCELLATIONS, TRANSFERS AND REFUNDS

 

  • The Venue Operator requires 7 days’ notice before the booked start time to provide a full refund for any cancellations for bookings of 9 participants or fewer. Any cancellations occurring with less than 7 days’ notice yet more than 24 hours’ notice will be offered a transfer to another Activity, or the same Activity but a different date and time or a credit note for the value of the booking. This requires the participant to specify an alternative Activity or date and time for their booking. With less than 24 hours’ notice cancellations will not receive a refund or transfer.
  • The Venue Operator requires 14 days’ notice to provide a full refund for any cancellations for parties or any group bookings for 10 participants or more. Any cancellations occurring with less than 14 days’ notice yet more than 7 clear days’ notice will be offered a transfer to another Activity, or the same Activity but a different date and time or a credit note for the value of the booking. This requires the participant to specify an alternative Activity or date and time for their booking. With less than 7 days’ notice all cancellations will not receive a refund or transfer.
  • Any cancellation under this clause 9 must be made by visiting the relevant site or emailing the relevant site whose email address is teesside@ninjawarrioruk.co.uk.
  • The terms of clauses 1 to 9.3 shall apply notwithstanding if your booking takes place within these time periods.
  • The Venue Operator shall be entitled to cancel your booking at any time. In the event that the Venue Operator requires to cancel your booking for any reason including but not limited to, technical, health and safety, IT error and/or operational reasons or due to special events or private functions, it shall use its reasonable endeavours to notify you as soon as possible. In the event of cancellation under this clause, you shall be entitled to transfer your booking to another date by time but no other compensation or refund shall be payable by the Venue Operator.
  • Payments made by debit or credit card will be refunded to the same card.
  • No refunds will be given for transactions made by gift vouchers. Bookings which were made by gift vouchers and which are cancelled pursuant to clauses 1, 9.2 and 9.5 of these terms and conditions may be transferred to another date and time.
  • Where multiple forms of payment are used, the Venue Operator reserves the right to refund any monies due by debit or credit card.
  • If your booking is rescheduled in accordance with this clause 9, you agree to waive any right to compensation, refund or rebooking that may be granted under these Terms in relation to the applicable rescheduled booking.

 

 

  1. DELIVERY OF SERVICE

 

  • Subject to these Terms, we shall provide the Activities to you at the Venue and as set out in the booking confirmation.
  • The Venue Operator shall use its reasonable endeavours to ensure that you and members of your booking’s participation in an Activity commences at the time booked. We require you and the participants in your booking to report to reception at the Venue at least twenty minutes prior to your booking time. Late arrivals may not be permitted to undertake the Activities and no refunds or compensation will be payable in such circumstance.
  • Any Ninja Warrior UK-branded merchandise items which are purchased online must be collected from within the Venue on arrival/when checking in.

 

  1. OUR LIABILITY TO YOU

 

  • Subject to the following paragraph, the Venue Operator, its employees, directors and agents are not liable to you, the participants in your booking, or your or their dependants or legal representatives for any claim for any indirect or consequential loss or damage, including without limitation personal injury or financial loss or damage, whether such liability arises in breach of contract, tort (including negligence), breach of statute or statutory duty or otherwise.
  • Nothing in these Terms is intended to nor shall limit the liability of the Venue Operator in respect of death or personal injury caused by the negligence of the Venue Operator or of its employees, agents or for fraud or fraudulent misrepresentation, or for any other liability which cannot be restricted by law, nor shall it or affect the statutory rights of any person dealing as a consumer.
  • The Venue Operator will not be held responsible for the loss or damage of or to any of your or the participants in your booking’s property or personal belongings during your visit to the Site or arising from the booking of or participation in the Activities. Personal possessions are brought into the Venue entirely at the owners’ risk.
  • If you are a consumer, the Venue Operator will be responsible for losses you suffer caused by the Venue Operator breaking this contract unless the loss is:

Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your booking meant we should have expected it (so, in the law, the loss was unforeseeable).

Caused by a delaying event outside our control. In accordance with clause 12 of this agreement, we’re not responsible for delays or other matters outside our control.

Avoidable. Something you could have avoided by taking reasonable action, including following our reasonable instructions for use.

  • Parking facilities are available near to the Venue and any vehicles and their contents are left at the owners’ risk and are subject to any conditions and the payment of any fees as may be required by the provider of such facilities at the Venue.
  • Except as otherwise stated, any liability of the Venue Operator shall be limited to the refund of any charges paid to the Venue Operator.
  • To the maximum extent permitted by law, the Venue Operator, ITV and TBS including their, employees, directors and agents are not liable for any injury, loss or damage (including damage to property or personal belongings) directly or indirectly arising out of or in connection with the use of any arcade or other games machine owned or supplied by a third party.
  • ITV and TBS shall not be liable or responsible for any failure to perform, or delay in performance of, any Venue Operator obligations under these Terms.

 

  1. EVENTS OUTSIDE OUR CONTROL

 

  • If an event outside of the Venue Operator’s reasonable control takes place that affects the performance of the Venue Operator’s obligations under these Terms, the Venue Operator will contact you as soon as reasonably possible and the Venue Operator’s obligations under these Terms shall be suspended for the duration of the event.
  • If an event outside of the Venue Operator’s reasonable control (including but not limited to reasons relating to COVID-19 or any public health emergency), which means that the Venue Operator will not be able to provide the Activities in accordance with your booking:
    • If the event takes place more than 7 days before the commencement of your booking, you may cancel your booking and the Venue Operator will provide you with a full refund; or
    • If the event takes place within 7 days before the commencement of your booking, you may cancel your booking and the Venue Operator will provide you with a voucher for a new visit or reschedule your visit for a later date.
  • If your booking is rescheduled in accordance with clause 2.2, you agree to waive any right to compensation, refund or rebooking that may be granted under these Terms in relation to the applicable rescheduled booking.
  • If it proves necessary to close the Site or cancel any Activities for reasons beyond the reasonable control of the Venue Operator and in circumstances where your party has commenced participation in the Activities, you shall not be entitled to any refund (in part or in whole). In such circumstances, the Venue Operator may, but shall not be obliged to, offer alternative dates or times at reduced rates.

 

  1. HOW TO CONTACT US

If you have any questions or if you have any complaints, please contact the Venue Operator at teesside@ninjawarrioruk.co.uk. Our customer service team will do their best to resolve any problems you have with us or our Activities.

  1. OTHER IMPORTANT TERMS

 

  • The Venue Operator may transfer its rights and obligations under these Terms to another organisation and we will always notify you in writing if this happens, but this will not affect your rights or the Venue Operator’s obligations under these Terms.
  • Nothing in these Terms shall confer on any third party or any benefit or right to enforce any of these Terms.
  • Each of the paragraphs of Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
  • If the Venue Operator fails to insist that you perform any of your obligations under these Terms, or if the Venue Operator does not enforce its rights against you, or if it delays in doing so, that will not mean that it has waived its rights against you and will not mean that you do not have to comply with those obligations. If the Venue Operator does waive a default by you, it will only do so in writing, and that will not mean that we will automatically waive any later default by you.
  • If you are not satisfied with the outcome of your complaint, you have other ways to resolve disputes with us:

You can go to court. These Terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you are a consumer and you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

  • These Terms are governed by English law. Unless otherwise stated in this agreement, you agree to submit to the exclusive jurisdiction of the English courts.

 

 

 

 

TERMS OF USE

Ninja Warrior UK Adventure Park Teesside (operated by NINJA LEISURE UK TEESSIDE LTD) Safety Agreement and Terms & Conditions of Participation, hereafter referred to as the PARTICIPANT AGREEMENT.

At Ninja Warrior UK Adventure Park Teesside we take your health and safety seriously. We wish to highlight that any of the activities available can be potentially hazardous physical activities and that participation can lead to a risk of injury and even death.

Before participating at the Venue in any capacity, all participants must register to participate by completing the form below (“The Participation Waiver”). Participants under the age of 18 must have the form completed by a parent or legal guardian.

I, the Participant or Parent/Guardian of Participant(s), confirm as follows:

I understand and accept that in participating in activities at Ninja Warrior UK Adventure Park Teesside that there is an element of danger and risk of physical or emotional injury, paralysis, death, or damage to me, to property or to third parties including participant(s) and others and consequently the participant(s) is/are to undertake to use Ninja Warrior UK Adventure Park Teesside equipment and facilities (the “Facilities”) and to conduct themselves while on Ninja Warrior UK Adventure Park Teesside’s premises, in a sensible and responsible manner and in compliance with all notices, instructions and directions as published or displayed from time to time and in compliance with any instruction given to the participant(s) by an authorised person in Ninja Warrior UK Adventure Park Teesside’s control. I understand that such risks simply cannot be eliminated without jeopardising the essential qualities of the activity. The risks include, among other things and without limitation, risk of cuts and bruises. Other more serious risks exist as well. Due to the nature of the activities there is a risk that participants may fall off equipment, sustain sprains or breaks, or could suffer more serious injuries. Transitioning between obstacles carries the possibility of any manner of accidents. Similar risks are also inherent in using the Foam Pits, Ball Pools, Jump Towers or Air Bags.
  2. I expressly agree and promise to accept and assume all the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate despite the risks. I warrant that I will only undertake obstacles and challenges that are within my ability level and throughout which I will be able to maintain control.
  3. I understand that the activities provided by Ninja Warrior UK Adventure Park Teesside require a reasonable level of fitness and agility and I warrant that I am fit and able to participate. I also warrant that the participant(s) is/are in a good state of health and free from any injury, medical condition, disease or illness which may be aggravated by participating in activities that makes it dangerous for me to partake in such activities I expressly agree and promise to accept and assume all of the risks associated with the activities.

Additionally, the participant(s) recognises that such a breach of this waiver is dangerous or may increase any risk of injury to the participant(s) or others or make it more likely that the participant(s) will be involved in an accident which could result in any form of injury during the activity.

  1. I acknowledge that the activities provided by Ninja Warrior UK Adventure Park Teesside are not available to pregnant women and that by accepting these terms I confirm that the participant(s) is/are not pregnant.
  2. I acknowledge that cosmetic body enhancements including but not limited to false nails, non-removable jewellery, piercings and other surgical additions could cause injury to the participant(s) of any activities. Ninja Warrior UK Adventure Park Teesside strongly advises any participant(s) to remove these if possible before participating or not to participate, as Ninja Warrior UK Adventure Park Teesside will not be held accountable for any injury caused to the participant(s).
  3. I acknowledge and agree that the participant(s) is/are responsible for their own safety and the safety of others whilst participating in activities. I understand that the activities may be undertaken without direct supervision following safety instructions and agree that the participant(s) will at all times wear any protective equipment provided by or required by Ninja Warrior UK Adventure Park Teesside to be worn and will ensure that the participant(s) complies/comply with all instructions given at any time during the activities by Ninja Warrior UK Adventure Park Teesside. by any of its staff, media or signage
  4. I agree that the participant(s) shall not participate in any activities provided by Ninja Warrior UK Adventure Park Teesside unless the participant(s) has/have undertaken Ninja Warrior UK Adventure Park Teesside‘s Safety Briefing or been made aware verbally of the Ninja Code or been directed to the signage relating to the ninja code in relation to the activities and confirm that the participant(s) will comply with these at all times whilst on the premises from which the activities will be carried out.
  5. I agree that the participant(s) will only attempt obstacles and challenges that are within the participant(s)’s skill and fitness levels and of which the participant(s) is/are able to retain control of at all times. That the participant(s) will also only use features that the participant(s) has/have the ability to use within the participant(s)’s skill and fitness levels. Obstacles and challenges are undertaken entirely at the participant(s)’s own risk and I will not hold Ninja Warrior UK Adventure Park Teesside  liable for any injury the participant(s) may attain whilst participating in these activities.
  6. I agree and promise to ensure the participant(s) accept(s) to be responsible for any and all risks existing and subsisting in the activities. I acknowledge that participation in the activities is voluntary and that the participant(s) elect(s) to participate despite the risks and agree to accept the consequences of doing so.
  7. I agree that the participant(s) will not use Ninja Warrior UK Adventure Park Teesside’s facilities and activities whilst under the influence of any drugs or alcohol.
  8. I agree that I will fully indemnify Ninja Warrior UK Adventure Park Teesside, its agents and employees against any claim brought by a third party for loss, damage, injury or death which has been caused by any action or omission of mine or any act or omission of any participant(s) of which I am the lawful parent or guardian or any participant(s) whose supervision is wholly or partly my responsibility at the time of the relevant act or omission that would, if they had agreed to the same with full capacity to do so, amount to a breach of these Terms and Conditions or which amounts to negligence or a wilful act or omission.
  9. I agree that when accompanying a child or children under the age of 13 years, I will comply and ensure that the child or children are safe and looked after. I will be present on site at all times and will not leave them unattended.
  10. I confirm and agree that the participant(s) will comply with all age, height & weight restrictions specified by Ninja Warrior UK Adventure Park Teesside from time to time. The participant(s) acknowledge(s) that if they do not comply with any of these restrictions or any other requirements put in place by Ninja Warrior UK Adventure Park Teesside from time to time, they will not be able to participate in the activities and agree that they will promptly withdraw upon request by Ninja Warrior UK Adventure Park Teesside.
  11. I acknowledge that nothing in these Terms and Conditions is intended to avoid liability, on the part of Ninja Warrior UK Adventure Park Teesside, for personal injury or death caused by the negligence or wilful act of its authorised personnel or agents.
  12. I and as parent or legal guardian of any accompanying children give consent and agree to Ninja Warrior UK Adventure Park Teesside photographing and/or recording myself and any accompanying children and to use any such photographs and/or recording solely and only for Ninja Warrior UK Adventure Park Teesside training, advertising or promotional purposes. I and any accompanying minors hereby waive any right to inspect or approve the use of any such material and acknowledge and agree that the rights to use such material shall not require payment or compensation of any kind to be made by Ninja Warrior UK Adventure Park Teesside to myself and/or any accompanying children. I am fully aware that I must contact a manager of Ninja Warrior UK Adventure Park Teesside if I do not wish to be a part.
  13. Should Ninja Warrior UK Adventure Park Teesside or anyone acting on their behalf, be required to incur legal fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. This means that I will pay all those legal fees and costs myself.
  14. The participant(s) consent(s) and agree(s) to the use by Ninja Warrior UK Adventure Park Teesside of CCTV monitoring for training, health and safety and security purposes.
  15. Ninja Warrior UK Adventure Park Teesside consents to the participant(s) and accompanying members of their group undertaking photography for their own non-commercial purposes only and for no other purpose whatsoever. However, the participant(s) and accompanying members of their group are not to use any drone type equipment at Ninja Warrior UK Adventure Park Teesside , without holding the correct permit(s), having the required training, licence(s) and Insurance, with supporting documentation being available, to operate the equipment, before seeking the approval of the senior management at Ninja Warrior UK Adventure Park Teesside.
  16. The participant(s) acknowledge(s) that Ninja Warrior UK Adventure Park Teesside is not and shall not be liable for any damage or loss to themselves, any third parties or property incurred whilst the participant(s) is/are undertaking the activities or are on the premises of Ninja Warrior UK Adventure Park Teesside.
  17. I acknowledge that I may be asked for proof of I.D at any age. I must be able to produce documents if necessary. Failure to do so can result in being refused to partake in activities.
  18. I confirm that I have read the above and adhere to the guidance set by the staff.
  19. I confirm I am over the age of 18 years, signing for myself as a participant and/or as the Parent/Guardian of (a) participant(s) under the age of 18 years old. I give my consent for participants age 13+ to attend the site  unaccompanied subject to a valid participant agreement being in date.
  20. In consideration of not being required to sign a fresh copy of this PARTICIPANT AGREEMENT before each visit, I further agree, save as set out in this paragraph, that this PARTICIPANT AGREEMENT shall apply to all visits within the next 12 months by me and by the minor participant in full. I agree that if there is a change in my personal circumstance within the next 12 months (including but not limited to a change in my health or age) that I shall be required to sign a fresh copy of this PARTICIPATION AGREEMENT. By clicking the box below this document, I acknowledge that if anyone is hurt or property damaged during my participation in this activity, I may be found by a court of law to have waived my or the minor participant’s right to maintain a lawsuit against Ninja Warrior UK Adventure Park Teesside or any PARTIES that are bound by the PARTICIPANT AGREEMENT on the basis of any claim from which I have released them herein. I have had sufficient opportunity to read this entire document prior to signing it and I have read and understood it and acknowledge that I have been recommended to seek legal advice prior to doing so, and I agree to be bound by its terms and further agree that in relation to any legal matters the laws of the United Kingdom shall apply.
  21. I agree, consent and understand that my Personal Data (as defined in the General Data Protection Regulation ((EU) 2016/679) and the subsequent UK Data Protection Legislation) is to be held and controlled by Ninja Warrior UK Adventure Park Teesside and that this is contractual provision between us both. How we use any personal data you give us is set out in our Privacy Policy: https://ninjawarrioruk.co.uk/teesside/privacy-policy/. I also confirm that I am happy for any and all Personal Data in their possession to be passed to any third party for medical purposes in the event that it becomes necessary. I confirm that I have read and understood the privacy policy.
  22. I agree as an adult participant, or the Parent/Legal Guardian or Supervising Adult of a minor participant (a minor being anyone under the legal age of 18 at the time of booking), or, where I am making a group booking, I expressly agree for and on behalf of each other member of your group booking, and in consideration of being permitted to participate in the activities at the Venue, give permission to be photographed and/or for video recording of all members of the applicable booking group and/or any minors within the booking group to take place whilst within the Venue, such imagery/video footage is only to be used for advertising and promotional purposes by the Venue Operator. I agree to waive all my (and each member of my booking group’s) rights to inspect or approve the use of any imagery and/or video footage, and acknowledge and agree that the rights granted to this release are without compensation of any kind.
  23. I, and each member of my group booking, expressly agree and hereby undertake that I, or any member of my group booking, shall not record the Venue, nor reproduce, broadcast or transmit such footage, in any manner or by any means whatsoever, in the absence of a specific written agreement with NINJA LEISURE UK TEESSIDE LTD relating to and permitting such recording, reproduction, broadcast or transmission.
  24. If the participant(s) is a minor, or are minors, (a person under the legal age of 18 at the time of booking), I, and each member of my group booking, agree that this Release of Liability and Assumption of Risk Agreement (“RELEASE”) is made on behalf of any minor participant(s) and that all of the releases, waivers and promises herein are binding on any minor participant(s). I, and each member of my group booking, warrant that I, and each member of my group booking, have full authority as either the Parent, Legal Guardian or as a Supervising Adult of the minor participant(s) to bind the minor participant(s) to these Terms.
